These Terms & Conditions ("Terms") govern your access to and use of StreamClip (the "Service"), operated by DYL SOLUCIONES LIMITADA, RUT 78.098.669-7, a company organized under the laws of the Republic of Chile ("Company", "we", or "our"). By registering or using the Service, you agree to be bound by these Terms and by applicable Chilean law, including Law No. 19,496 on Consumer Rights Protection and Law No. 19,628 on the Protection of Privacy.
1. Acceptance and Legal Capacity
By creating an account or using the Service you confirm that you are at least 18 years of age and have full legal capacity to enter into this agreement under the Chilean Civil Code. Persons under 18 may only use the Service with the express authorization of their legal representative.
If you use the Service on behalf of an organization, you represent that you have authority to bind it to these Terms.
2. Description of the Service
StreamClip is a SaaS platform that provides AI-powered video editing tools, automatic caption generation, and content publishing to social platforms (TikTok, Instagram Reels, YouTube Shorts, and other compatible platforms).
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time. For material changes that affect active paid subscriptions, we will give at least 30 days' notice.
3. Registration and User Account
To access most features you must create an account with accurate and current information. You are solely responsible for keeping your credentials confidential and for all activity carried out under your account.
If you suspect unauthorized access, notify us immediately at support@streamclip.io. We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or have been inactive for more than 24 months.
4. User Content
You retain ownership of all content you upload to the Service ("User Content"). By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to process, store, and use it solely for the purpose of providing the Service.
You are solely responsible for having all rights, licenses, and permissions necessary for the content you upload. You must not upload content that infringes intellectual-property rights, image rights, or other third-party rights protected by Chile's Intellectual Property Law (Law No. 17,336).
We do not claim ownership of your content nor sell it to third parties.
5. Prohibited Uses
It is expressly prohibited to use the Service to:
- Upload, share, or distribute illegal, defamatory, obscene, violent content, or content that violates fundamental rights
- Infringe third-party intellectual or industrial property rights
- Reverse-engineer, decompile, or attempt to extract the Service's source code
- Use automated scripts, bots, or scrapers without prior written authorization
- Bypass usage limits, account restrictions, or security measures
- Attempt unauthorized access to other users' accounts or our systems
- Use the Service in a way that may disable, overload, or damage our infrastructure
- Engage in any activity that violates applicable Chilean law
6. Subscriptions, Billing, and Paddle
Some features require a paid subscription. Prices are detailed on our pricing page and include VAT (19%) where required by Chilean tax law.
Paddle as Merchant of Record: All payments are processed by Paddle.com Market Limited ("Paddle"), acting as StreamClip's authorized reseller (Merchant of Record). This means the purchase transaction takes place between you and Paddle, who handles billing, invoicing, tax compliance, and refund management. By subscribing, you also accept Paddle's Buyer Terms.
Subscriptions auto-renew at the end of each billing period (monthly or annual) until cancelled. You may cancel at any time from your account settings, with no penalty.
7. Right of Withdrawal (Law No. 19,496)
Under Article 3 bis of Chile's Consumer Protection Act (Law No. 19,496), you have the right to withdraw from your subscription within 10 business days of contracting it, when the contract was concluded remotely (electronically).
This right does not apply if the digital Service has begun execution with your express consent before the withdrawal period expires. To exercise this right, contact us at billing@streamclip.io within the indicated period.
Our Refund Policy may grant more favorable conditions than those established by law.
8. Intellectual Property
The Service, including its software, designs, logos, and content created by StreamClip, is our property and is protected by Chile's Intellectual Property Law (Law No. 17,336) and other applicable regulations. You may not copy, modify, distribute, or create derivative works based on our Service without prior written authorization.
9. Third-Party Services
The Service integrates with third-party platforms (TikTok, Instagram, YouTube, among others). Use of those platforms is governed by their own terms and conditions. We are not responsible for the actions, policies, or service interruptions of third parties.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available", without express or implied warranties beyond the non-waivable obligations established in Law No. 19,496. We do not warrant that the Service will be free from errors, interruptions, or harmful components.
11. Limitation of Liability
To the maximum extent permitted by Chilean law, DYL SOLUCIONES LIMITADA shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or reputational harm.
Our total liability for any claim under these Terms shall not exceed the amount you paid in the 12 months preceding the event giving rise to the claim. Nothing in this clause limits rights granted to consumers on a non-waivable basis under Law No. 19,496.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of Chile. Any dispute that cannot be resolved amicably will be submitted to the ordinary courts of justice of the city of Santiago, Chile, with the parties waiving any other forum that might otherwise apply.
Consumers may also refer to the Servicio Nacional del Consumidor (SERNAC) to mediate consumer disputes.
13. Changes to These Terms
We may update these Terms periodically. When we do, we will update the "last updated" date and, for material changes, notify you by email or a prominent in-Service notice at least 30 days in advance. Continued use of the Service after the effective date constitutes acceptance of the changes.
